Is THC legal in Minnesota?

Is THC legal in Minnesota?

The short answer is yes!

Minnesota has been legal for medical use since July 1st, 2015 and has 17 qualifying conditions that would qualify you for the program such intractable pain, cancer, aids, Tourette syndrome and more.

Up until recently these medical THC products have consisted mainly of capsules, tablets, vape cartridges, raw THC and topicals. Normally the price of medical THC has been very high compared to traditional cannabis pricing.

In 2021 Minnesota also passed to allow for edibles like gummies and hard candies, flowers and joints. The only way to get THC flowers is thru the Minnesota Medical Cannabis Program.

Adult Use THC legalized July 1st, 2022 in Minnesota

On July 1st, 2022 Minnesota passed an amendment to 151.72 to allow for up to 5mg of THC per serving and 50mg of THC per package for anyone who is 21 and older. The only requirement is that the THC must be source through hemp rather than marijuana.

There is no difference what so ever between THC that is derived from hemp and THC that is derived from marijuana. It is just the licensing and rulemaking that are different.

What kind of THC products can I buy in Minnesota?

You can purchase THC edibles that have up to 50mg THC a package. THC flowers, joints and dabs are not legal yet for adult use 21+ and are only found through the medical program. However we do have other cannabinoids that work similarly to THC and are in flower, joint and dab form.

You can purchase any cannabinoid product that is derived from hemp so long as it is under 0.3% of any form of THC, including Delta-8 THC. While you will find 5mg/serving 50mg/package of THC in gummies, chocolates, drinks and more you will also find new products like HXC, HHC, THCV, THCH, THCP that are all hemp derived cannabinoids that have similar effects to THC while remaining at higher percentages.

What are the lab testing requirements for Adult Use THC in Minnesota?

In Minnesota all products that contain cannabinoids for Adult Use must be tested and contain no traces of pesticides, heavy metals, fertilizers, residual solvents and mold. While these labs aren't required to be made public, they are required to be shown to the state upon request. Here at Love is an Ingredient all of our Full Panel Lab Results are available to the public and can be found by click Lab Reports at the bottom of this page.

The lab report must also show that there is no more than 0.3% of any form of THC in the product. This is to prevent any THC flowers or concentrated forms of THC being sold for Adult Use. Only edibles are legal for Adult Use THC.

Do Adult Use THC products have any packaging requirements in Minnesota?

Yes, in Minnesota all edible cannabinoid products must be packaged in a child resistant package and bear the words "KEEP THIS PRODUCT OUT OF REACH OF CHILDREN". There is an exception for the child resistant requirement for beverages that do not contain any trace amounts of THC.
